Terms of sale
These terms apply when you buy from our website.
Who we are
We are HAWORTHGALLERY LTD, trading as Abrahams Gallery, a company registered in England and Wales with company number 16644663. Our registered office is 83 Main Street, Haworth, Keighley, BD22 8DA. You can contact us at contact@abrahamsgallery.com or on 01535 642670.
We are not registered for VAT, so no VAT is charged or shown.
Who you are buying from
- Most of the artwork in the gallery is sold by us on behalf of the artist who made it. Where that is so, the piece's page says "Sold by Abrahams Gallery on behalf of" followed by the artist's name, and the artist is the seller.
- Some pieces, including most of the prints we buy in, are owned and sold by us. Their page says "Sold by Abrahams Gallery".
- Either way, you deal with Abrahams Gallery for everything: your order, payment, delivery, returns, and anything that goes wrong. Each artist can be contacted care of the gallery at the address above.
What we sell
- Original artworks are one of a kind. Once an original is sold it cannot be replaced.
- Prints may be available in more than one size. The size and price are shown before you buy.
- Each piece's page says how it is sold, for example framed and ready to hang.
- We take care that photographs and descriptions are accurate. Colours vary from screen to screen, and sizes are approximate to within 1 cm.
Your order
- Your order is an offer to buy. The contract is made when we email you to confirm the order.
- Because originals are unique, a piece may occasionally sell in the gallery at the same moment you order online. If that happens we will tell you straight away and refund you in full.
- A piece shown as "Gallery only", "Reserved" or "Sold" cannot be bought online. You are welcome to ask us about it.
- If a price on the website is obviously wrong, we will contact you before taking the order any further, and you may cancel.
Price and payment
- Prices are in pounds sterling. Delivery or packing charges, where they apply, are shown before you pay.
- Payment is taken by card through Stripe when you place your order. We never see or store your full card number.
Ownership and responsibility
- The piece becomes yours when payment has been received in full.
- If we arrange delivery, the piece is our responsibility until it is delivered to you or to someone you have named.
- If you arrange your own courier, the piece becomes your responsibility when we hand it to them.
- If you collect, the piece becomes your responsibility when you collect it.
Copyright
Buying an artwork does not give you the copyright in it. You may not reproduce the image, or any image from this website, without written permission from the artist or from us.
If something is wrong with your purchase
You have legal rights if a piece is faulty or not as described. Nothing in these terms reduces those rights. See Returns and cancellations for what to do.
Our responsibility to you
- We do not limit our responsibility where it would be unlawful to do so. This includes death or personal injury caused by our negligence, fraud, and your legal rights as a consumer.
- We sell for private, domestic use. We are not responsible for business losses such as lost profit or lost opportunity.
- We are not responsible for delays caused by events outside our reasonable control. If such a delay is substantial, you may cancel and receive a full refund.
If you are buying for a business
If you buy in the course of a business:
- The 14-day right to cancel in Returns and cancellations does not apply.
- Risk in the piece passes to you when it leaves our premises. We are responsible for damage in transit only where it is shown to result from our own packing or handling.
- Any claim must be made in writing within 5 working days of delivery.
The law that applies
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland you may also bring a claim in your local courts.
